Now C.S.'s mother, Sherrita Smalley, has filed suit against RK, claiming that her underage daughter and Bieyanka Moore are one and the same — constituting "sexual battery, statutory rape, [and] child pornography."
RK claims the actress known as Bieyanka Moore provided producers with a valid Nevada learner's permit, purporting her to be 19-year-old Tyler Chanel Evans, and a corresponding social security printout. If those documents were bogus — as RK appears to concede in some filings — it's the minor's fault: "But for this criminal activity by C.S., she never would have been able to mislead [RK]," the company insisted in court.
As the case unfolds, there is one person who should be worried: the as-yet-unidentified actor who had on-camera sex with the girl. Florida law decrees that "a minor's misrepresentation of his or her age... may not be raised as a defense" in statutory rape prosecution.

I remember this whole thing and her claiming on her twitter that this was all a hoax and that it would be cleared up. Needless to say their were no more scenes from her and every site that had the scene quickly took it down.

This case AND the L.T. underaged prostitute case (yeah..she was black) Ya see, that's why I don't fuck with black chicks no more.

I don't think she'll win. This is different than the lt case; That case wasn't just about the girl being a minor, but kidnapping, and prostitution.
This is about a legit business.
She presented herself as an adult, ID..SS card. RK had their ducks in a row....she'll lose.

For the sake of sanity and normality, she better lose. She lied about her age and used forged documents. What the F else are legit businesses supposed to do to check ID? The 'victim' has to be held responsible.

If the actor's lawyer is moderately competent, he'll make the point that she didn't misrepresent her age to him (the actor), thus the onus isn't on the actor.
The porn company hiring her and verifying her age supplied her as someone who'd been thoroughly vetted and the burden wasn't on him to verify her age.
Now there's some reasonable argument to be made that he could walk off the set, I suppose for fear she's underage, yet that might not hold water as his walking off set could impair his future earnings (by making him appear unreliable).
The law as it appears to me, is to insure that a guy simply can't pick up a young looking girl, say she had a fake i.d. and thus he isn't to blame.
This is a case where meticulous records are kept to avoid such an incident, so it will have a different standard. They took every reasonable precaution to verify her age.
